Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes what is and isn't allowed when you use the getFIXLY services, including the marketing site, blog (including comments), community forum, and paid SaaS products (collectively, the "Services"). It is part of, and incorporated by reference into, our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms.
The Services exist to help homeowners, builders, inspectors, warranty representatives, and related professionals coordinate the new-home handoff workflow. This AUP is meant to keep the community honest, factual, and safe — and to protect us, our users, and third parties from harm.

1. Don't break the law
You may not use the Services to do anything illegal, or to facilitate, encourage, or solicit illegal acts. This includes (without limitation) violating intellectual-property laws, privacy laws, consumer-protection laws, securities laws, or laws against fraud, harassment, or threats.
2. Don't infringe IP or other rights
You may not post or share content that infringes any third party's copyright, trademark, trade secret, patent, right of publicity, right of privacy, contract, or other right. Examples: posting photos you don't have rights to, copying long passages from a paid inspection report or warranty document without permission, using another company's logo as your avatar, or posting trade-secret information from a former employer.
3. Don't harass, threaten, or harm others
You may not use the Services to harass, threaten, intimidate, defame, stalk, dox, or otherwise harm any person or organization. This includes (without limitation):
- Personal attacks, slurs, hate speech, or content that degrades or demeans people based on protected characteristics;
- Sexual harassment or unwanted sexual content;
- Threats of violence or content glorifying violence;
- Posting personal information about others without consent (home addresses, phone numbers, financial details, etc.);
- Coordinated harassment or "pile-ons" against another user, builder, inspector, or company.
Our forum is a place for vigorous discussion, including criticism of products, services, and workflows. Criticism of a builder's quality, an inspector's findings, or a warranty experience is allowed. Personal attacks, fabricated claims, and harassment of identifiable people are not.
4. No fake reviews, no astroturfing, no impersonation
The community is only useful if you can trust it. So:
- Don't impersonate any person or organization, or misrepresent your affiliation. If you're a builder employee, don't pose as a homeowner. If you're an inspector, identify yourself as one when discussing inspection topics.
- Don't post fake reviews — positive or negative — about builders, inspectors, products, or services. Don't post a review you were paid or otherwise compensated for, unless that compensation is clearly disclosed.
- Don't run sockpuppet accounts — multiple accounts to amplify your own voice or to evade moderation.
- Don't astroturf on behalf of any company, builder, inspector, or product.
If you have a financial relationship with a person, product, or company you're discussing (e.g., you're a builder's marketing contractor, you receive referral fees, you're an affiliate), disclose it in the post.
5. No spam, no scraping, no abuse
- No unsolicited bulk content, repetitive posts, off-topic promotions, "buy my course," or pyramid/MLM-style content.
- No phishing, malware, or attempts to trick others into sharing credentials, payment information, or other sensitive data.
- No automated scraping, crawling, or harvesting of the Services beyond what's permitted by our
robots.txtand any documented APIs, and not in violation of any rate limits we publish. - No probing, scanning, or testing the Services' security without our prior written authorization (we welcome responsible disclosure — email support@getfixly.app).
- No interference with the Services or the experience of other users (DDoS, flooding, exploiting bugs, abusing rate limits, etc.).
6. No malicious or harmful technical content
Don't upload or transmit viruses, malware, time bombs, ransomware, keyloggers, or any other harmful code. Don't use the Services to attack any other system.
7. No professional impersonation
You may share opinions, experiences, and general information. You may not:
- Hold yourself out as a licensed professional (lawyer, engineer, licensed home inspector, contractor, etc.) when you aren't.
- Provide individualized professional advice that creates a duty to a specific user (e.g., diagnose specific structural problems for a specific home and tell that homeowner exactly what to do).
- Make legal threats on behalf of someone else.
When in doubt, frame contributions as your experience and opinion, and recommend that other users consult qualified, licensed professionals.
8. Be careful with names and reviews of identifiable people or businesses
The Services let users discuss real builders, real inspectors, and real products. That's a feature, not a bug — but it carries responsibility:
- Stick to the facts. If you're describing a defect, describe what you observed; don't make it up.
- Distinguish opinion from fact ("In my opinion, this builder's punch-list response was poor" vs. "This builder commits fraud").
- Don't post content you know to be false about an identifiable person or business.
- Don't post a review for a transaction you didn't actually have.
- Don't post photos of anyone (including children, contractors, or inspectors) when they would have a reasonable expectation of privacy.
We may remove content we believe is defamatory, harassing, or otherwise unlawful. We may also restore content if we believe a removal was made in error. We are not in a position to adjudicate disputes between users about what really happened on a project; in serious disputes, the parties may need to use legal process.
9. Don't post sensitive personal information
Don't post other people's:
- Government identifiers (Social Security numbers, driver's-license numbers, passport numbers);
- Bank or credit-card numbers;
- Medical information;
- Login credentials;
- Home addresses, when not relevant to a public discussion;
- Children's personal information.
Be mindful when posting photos of homes — addresses, license plates, smart-home unique identifiers, and identifying landmarks can compromise the safety of the resident. Crop or blur as appropriate.
10. Sexual content and content about minors
- No sexually explicit content.
- No nudity, sexual content, or content that sexualizes minors. This is a zero-tolerance category and will result in immediate account termination and reporting to relevant authorities.
- No content depicting or encouraging the abuse, exploitation, or endangerment of children.
11. Use the Services only for lawful purposes
Don't use the Services in connection with terrorism, human trafficking, drug trafficking, illegal weapons, fraud schemes, or any other illegal activity, and don't use the Services in violation of U.S. export-control or sanctions laws.
12. Reporting and enforcement
Reporting. To report a violation of this AUP, email support@getfixly.app with details (URL, screenshot, why you believe it violates this AUP). For copyright issues, follow the DMCA Policy. Reports made in bad faith may themselves violate this AUP.
Moderation actions. We may, at our discretion and without prior notice, take any of the following actions when we believe content or conduct violates this AUP, the Terms, or applicable law:
- Remove or hide specific content;
- Edit a post (e.g., to redact sensitive information) and add a note;
- Lock a thread or restrict a sub-forum;
- Issue a warning to a user;
- Limit a user's posting privileges (rate limits, "slow mode," temporary read-only);
- Suspend an account;
- Terminate an account permanently;
- Refer the matter to law enforcement.
Repeat infringers. We will terminate accounts that repeatedly engage in serious or willful violations, including repeat copyright infringement (see DMCA Policy).
13. Appeals
If you believe a moderation action against you was made in error, you may appeal by emailing support@getfixly.app within thirty (30) days of the action. Include your account email, the action taken, the content involved (if any), and why you believe the action was incorrect. We aim to respond to appeals within ten (10) business days. Appeals are reviewed by a member of the team who didn't make the original decision, where reasonably possible.
14. Changes to this AUP
We may update this AUP from time to time. Material changes will be communicated via the same channels described in our Terms. Your continued use of the Services after the effective date means you accept the changes.
